The implementation of the European patent reform is well underway: both the Unitary Patent and the Unified Patent Court should enter into play by the end of 2015. Consequently, U.S. companies will need to full rethink their patent strategies in Europe (i.e. patent filings, portfolio management and litigation). In particular, U.S. companies should take into account practical issues such as the possibility to opt-out of the Unified Patent Court's jurisdiction and the insertion of specific provisions in patent agreements.
