Dr. Moon accused Dr. Wolff and his research company of breaching fiduciary duty, aiding and abetting, and unjust enrichment related to the dissolution of a business partnership. Dr. Moon alleged that Colorado Neurological Research Company created a competing business, and the lawsuit could have resulted in millions of dollars in past and future lost profits.
Reed Smith’s trial team, led by partners Adam Massaro and Joyce Williams, focused the trial presentation on using the financials of both businesses to show that their clients were not liable and that there were no damages. The trial team, which has tried four cases together in the last year, developed trial visuals that made the financials easily digestible. Massaro, who has begun using artificial intelligence in his trial preparation, also used Reed Smith’s AI resources to assist with his preparation and cross-examination of the opposing side’s damages expert—a critical witness to challenge at trial. The trial team narrowed the issues for trial by obtaining dismissal of tortious interference, waste of corporate resources, and common law misappropriation claims at summary judgment, leaving only two claims for trial.
This is the second trial that the team has handled between these parties. In August 2024, Massaro and Williams obtained a complete defense verdict for Dr. Wolff in another suit brought by a different entity Dr. Moon controlled.
