On November 18, 2002, Allegheny County Judge R. Stanton Wettick, Jr., a trendsetter among Pennsylvania jurists, decided that Pennsylvania law recognizes the tort (i.e., civil wrong for which a party can be sued) of aiding and abetting the breach of a fiduciary duty.  Infosage, Inc. v. Mellon Ventures et al., No. GD01-16476 (C.P. Allegheny County Nov. 18, 2002) (Wettick, J.).  Faced with an issue of first impression, Judge Wettick based his decision on the extensive protections that Pennsylvania law affords a party to whom a fiduciary duty is owed.  This expansion of Pennsylvania tort law has far reaching implications for many cases and causes of action, especially those in restrictive covenant and business divorce context.
