The Court of Justice of the European Union (CJEU) ruled on Tuesday, April 26, 2022 that Article 17 of the DSM Copyright Directive 2019/790 is effective and dismissed Poland's action for annulment. A few days earlier, an agreement was found between the European Parliament and EU Member States on the proposal on the Digital Services Act (DSA).
In the session, we will cover:
- Summary of the CJEU decision in the “Polish challenge” and lessons learnt from the court ruling.
- A comparison and a discussion about the take-down and content removal obligations under Digital Services Act (DSA) and Article 17 of the Copyright Directive.
