CMS’s proposed regulations include extensive changes to many of the Stark Law’s fundamental elements, like the “volume or value standard”, “commercial reasonableness” and “fair market value”. They also include numerous revisions to, and new interpretations of, key definitions and commonly-used exceptions. These fundamental changes, which will have widespread impact, go beyond the proposals for exceptions for value based arrangements and donations of electronic health records and cybersecurity technology.
