President Trump has signed into law the Coronavirus Aid, Relief, and Economic Security Act (the CARES Act or Act),1 sweeping legislation intended to bolster the nation’s response to the COVID-19 pandemic. In addition to offering economic relief to individuals and impacted businesses, the Act shores up the nation’s supply of drugs and equipment, expands coverage of COVID-19 testing and preventative services, addresses health care workforce needs, eases restrictions on telehealth services during the crisis, increases Medicare regulatory flexibility, and authorizes $100 billion for eligible health care providers, among many other things. This was the third emergency COVID-19 response measure signed into law to date, following the Coronavirus Preparedness and Response Supplemental Appropriations Act2 and the Families First Coronavirus Response Act (Families First Act).3 Congressional leaders have indicated that additional legislative action is contemplated.
