Defended nation’s largest, publicly traded inpatient rehab facility (IRF) company in resolving six False Claims Act qui tam actions consolidated in the Middle District of Florida (Tampa). All six cases were resolved by settlement for less than 5% of DOJ’s original demand, securing a broad release of 130 hospitals and no CIA.
Defended global, publicly traded medical device company in federal criminal investigation of accounting and health care fraud. Despite the eventual felony conviction of the company’s CEO and CFO, Jeff’s team secured a favorable resolution for the company, including a 2-year DPA with no monitor, and a fine substantially smaller than that suggested by the federal sentencing guidelines.

Defended world’s leading retail pharmacy chain in multiple Texas Attorney General investigations of Medicaid fraud, including allegations of: improper setting of usual and customary price of drugs; dosage form switching to avoid MAC pricing; and billing for prescriptions that had been “returned to stock.”
Successfully represented global pharmaceutical company in state false claims case brought directly by the State of Louisiana alleging marketing of an unsafe drug. Jeff secured a dismissal in state court in Baton Rouge despite the personal appearance of the Louisiana Attorney General to oppose the motion.
Represented Texas Medicaid administration contractor in a Texas Attorney General investigation alleging the company fraudulently administered benefits without the required prior authorization review.
Secured dismissal of False Claims Act action brought in Boston against major global pharmaceutical company, alleging a national scheme to bribe and deceive prescribing physicians.
Represented global, publicly traded medical device manufacturer in separate qui tam actions filed in Boston and Memphis alleging improper sales to the Department of Defense in violation of FAR requirements. One case was dismissed, and the other settled for $100,000 after Jeff’s team eviscerated the whistleblower’s claims during discovery.
Secured dismissal of False Claims Act whistleblower action filed in San Antonio against the largest nonprofit health system in Texas. The whistleblower alleged purposeful upcoding across the system.
Defended two separate cases brought against long term care acute hospitals (LTACHs) in the Southern District of Texas. One case was dropped after we persuaded the DOJ not to intervene, and the other was settled favorably.
Represented bariatric surgical device manufacturer in investigation of “surgeon locator service” by DOJ and the Maryland US Attorney’s Office. Thanks to the defense of Jeff’s team and previous compliance advice given to the company, DOJ dropped the company from its ongoing investigation.
Defended nation’s largest seller of mobility scooters in criminal investigation of allegedly wide-spread marketing and billing fraud. During the course of the investigation, the team navigated a bankruptcy and negotiated continued Medicare payments directly with CMS.
Conducted multiple internal investigations for life-sciences companies for suspected violation of Anti-Kickback Statute and Foreign Corrupt Practices Act.
Investigated and self-disclosed improper relationship between a teaching hospital and its teaching physician groups in the Southern District of Texas. Resolution involved direct negotiations with DOJ, OIG, CMS and a state university system.
Represented multiple hospital systems in Texas and Louisiana in class action litigation alleging improper billing of uninsured or underinsured patients.
Representation of multiple Texas health systems in “one-day stay” qui tams brought in the Southern and Western Districts of Texas. All cases were resolved favorably, and one was dropped by the DOJ after we successfully demonstrated the hospital’s efforts to comply with the rule.
