Duffy, Iqbal Hussain, and John Ellison will discuss the steps that companies should take now to position themselves for international arbitration claims that may arise from challenges such as export restrictions in India and decreased API manufacturing in China and elsewhere. The presenters will further examine clause drafting issues, the consequences of choosing common law over civil law as the governing law of the contract, how to select arbitrators for pharmaceutical supply chain disputes, and how companies should address indemnification obligations and insurance matters.
