Therese is a partner in Reed Smith's Emerging Technologies and Records & E-Discovery Groups. She focuses her practice on enterprise data risk management and information governance, data privacy and security, cyber security, records and eDiscovery.
Data Risk Management and Information Governance
Therese has worked with large financial services institutions, industrial companies, technology companies, food products companies and pharmaceutical companies to develop strategies for managing the legal and regulatory issues relating to both traditional and innovative proprietary and developing technologies and data sources. She counsels clients on all aspects of data risk management, including: data breaches and data privacy; cross-border data transfers; data migrations; cyber-security; technology implementation and management; the development of policies and procedures regarding the governance of information in various technologies; eDiscovery strategy and management; the use of data analytics for eDiscovery, compliance and risk management; and the remediation of legacy data (both paper and electronic).
Data Privacy and Security
Therese has advised clients on data privacy, data security and data management compliance pursuant to the GLBA, FCRA, COPPA, state data security laws, and related state deceptive trade practices laws, including data breach response and notification. She advises clients on data security and privacy risks associated with data segregation, transfer and retention in mergers and acquisitions and technology transactions. Therese works with clients to manage supply-chain risk and vendor management, including contractual agreements and practical implementation of security and data sharing protocols. Therese has represented clients in both reactive and proactive negotiations with state and federal regulators, including, the NYAG, SEC, CFPB, Federal Reserve and FINRA, on such matters as data security, cross-borders data transfer, data retention and remediation, and internal data governance. She has also represented numerous clients before the U.S. state and federal courts on issues concerning consumer and data privacy, cross-border data transfer and data security.
E-Discovery
Therese has represented and advised clients on all aspects of the discovery and management of electronic information including the development of policies and procedures for the preservation, collection, review and production of electronically stored information, the remediation of legacy data, and strategic positioning and defense of electronic discovery issues before federal regulators and the courts. In both her litigation and electronic discovery practices, Therese has worked with technology companies and other organizations to develop strategies for managing the legal issues relating to both traditional data and innovative proprietary and developing technologies and data sources.
