Users of the Hong Kong International Arbitration Centre (HKIAC) will now gain access to an additional route to seeking interim relief and enforcement of arbitral awards in mainland China, following the latest notice issued by the General Office of the Supreme People’s Court (SPC) on 22 June 2022.

On 22 June 2022, the SPC’s General Office issued the “Notice of the General Office of the Supreme People’s Court on Inclusion of the Second Group of International Commercial Arbitration Institutions in the ‘One-Stop’ Diversified International Commercial Dispute Resolution Mechanism” (Notice). Pursuant to the Notice, HKIAC will be included in the second group of arbitration institutions in the ‘one-stop’ diversified international commercial dispute resolution mechanism (One-Stop DR Platform) under the China International Commercial Court (CICC).

According to the Procedural Rules for the China International Commercial Court of the Supreme People’s Court (For Trial Implementation), the inclusion of HKIAC in the One-Stop DR Platform means that parties to cases administered by HKIAC with an amount in dispute exceeding RMB 300 million or cases that are otherwise significant may apply directly to the CICC for interim relief and/or enforcement of arbitral awards. This provides parties in appropriate cases with a potentially more efficient alternative to the existing means of applying to the competent intermediate people’s court in mainland China for interim relief and enforcement of arbitral awards.

The inclusion of HKIAC in the One-Stop DR Platform signifies the continuing importance of Hong Kong as an international dispute resolution centre.
