Michael is a member of the firm's Global Commercial Disputes Group. He concentrates his practice in the defense of class action privacy claims and has tried jury and bench trials in both state and federal courts. For more than 20 years, Michael has successfully defended against asserted class claims brought under the federal Fair Credit Reporting Act (FCRA), and its attendant threat of statutory damages.
Michael has represented a wide array of data furnishers in matters involving various types of sensitive consumer information, such as credit bureaus and credit reports, employment screening companies and criminal record information, and insurance support organizations and medical information. He has also represented a broad variety of defendants, among them Internet service providers, cellular phone companies, retailers and a leading national airline, in class action and commercial litigation involving phone records, credit scores and other large amounts of electronic data.
Michael’s practice also includes counseling clients regarding compliance with a wide spectrum of state and federal laws governing the use and disclosure of consumer financial, health and other information and related regulations (such as the Fair Debt Collection Practice Act and Equal Credit Opportunity Act).
