Ginevra’s litigation practice focuses on complex class and individual cases involving financial services, employment, healthcare, retail, and commercial disputes. In particular, Ginevra has defended more than a dozen putative class actions in Pennsylvania, New York, Florida, California, Tennessee, Maine, and Montana; and her expertise includes claims brought under various federal and state consumer protection statutes, the CARES Act, and ERISA, and claims that involve large-scale ESI. Ginevra also has deep experience advising clients on garnishments, leading a team of attorneys to provide risk management and compliance counseling to multiple national and regional bank clients regarding exemptions and geographical limitations, procedures and training manuals, responding to agency inquiries, maritime attachments, garnishments implicating escheatment, and other ad hoc complex garnishment matters.

Experience

Representative matters

Defending $300 million breach of fiduciary duty claim in Pennsylvania federal and state court by income beneficiary of family trust.
Defending PPP lenders in pre- and post-litigation disputes challenging the origination and forgiveness of loans under the CARES Act’s Paycheck Protection Program, and secured case-of-first-impression dismissal of such claims.
Counselling multiple regional and national banks on compliance with states’ garnishment and setoff laws, including in connection with responses to agency inquiries; development of policies, procedures, and training manuals; maritime attachments; high dollar value garnishments; and other complex matters.
