As these technologies transition from emerging novelties to daily aspects of life, questions regarding the legal implications of these technologies continue to arise. When humans can no longer objectively analyze an AI’s decision-making processes, by what standard do we judge their behavior? When inherent biases, such as collusive pricing or product allocation algorithms, are imputed to an AI by its creator, who is at fault when such an AI makes decisions that lessen competition, potentially in violation of state and federal antitrust laws? When an AI creates original expression or invents a new idea, who owns the associated intellectual property? Can we discern trends in efforts to protect technologies surrounding intellectual property? How is the growing use of AI changing companies’ insurance needs? The panelists will answer these questions and more based on current trends in the law, while providing attendees with a basic understanding of what these technologies are, and how they are affecting the daily thinking of business leaders, in-house counsel, and insurance risk managers today in order to enable attendees to make educated decisions when employing – or not employing – these new technologies.
