On June 19, 2003, the Department of Transportation, Federal Transit Administration ("FTA") issued its revised version of Circular 4220 now 4220.1E. This revised circular spells out the requirements that must be followed by grantees and subgrantees "in the solicitations, awards, and administration of third party contracts" under FTA assistance programs. Importantly, the Circular 4220.1E recognizes, for the first time, that "violations of Federal law or regulation" is a separate basis for FTA bid protest jurisdiction.
