Shannon McClure and Regina Nelson’s article, “Using Documents to Prepare a Rule 30(b)(6) Witness,” appeared in The Legal Intelligencer on October 14th. The article provides a brief background of the current law in Pennsylvania federal courts, demonstrates the conflict that exists between the Federal Rule of Civil Procedure 26(b)(3) work-product rule, Rule 30(b)(6) and Federal Rule of Evidence 612, and plots a potential course a court may take if presented with a motion to compel documents that a Rule 30(b)(6) witness reviewed in deposition preparation.
