The UK government has published a draft text of the withdrawal agreement that concerns the UK’s exit from - and future relationship with - the European Union.

London partner Cynthia O’Donoghue has written an article for the International Association of Privacy Professionals’ publication Privacy Tracker, summarising the UK’s position under this draft agreement, and in light of the European Commission and the UK’s outline political declaration.

The article covers the UK’s general approach to data protection after Brexit; the data protection rights that will exist during the transition period; and how transfers of personal data to and from the UK will be made post-Brexit. It is uncertain whether the UK will benefit from a future adequacy decision.
