Brian is a senior associate and Certified Information Privacy Professional (CIPP/US) who specializes in litigating complex commercial matters, advising clients with respect to regulatory compliance, and guiding institutions through internal and government investigations. Brian also regularly drafts and reviews agreements and internal policies for clients in a variety of industries.
In the financial industry, Brian has extensive experience litigating commercial disputes and class actions involving mergers and acquisitions, securities, contract and fraud claims, and federal and state consumer protection statutes. Brian also advises and defends colleges and universities in matters involving student affairs, drafting and updating internal procedures, Title IX, scholarship equity, and the impact of COVID-19 and NCAA policy changes related to NIL and other issues.
Brian has particular expertise in the area of evidentiary privileges including the attorney-client privilege and work product doctrine; he uses this knowledge to assist corporate clients and non-profits in safeguarding sensitive advice and other information in the context of litigation, investigative subpoenas, and transactional diligence and negotiations. In addition, Brian is experienced with a broad range of consumer and data privacy statutes, including FERPA, HIPAA, the Fair Credit Reporting Act (FCRA), and the Fair and Accurate Credit Transactions Act (FACTA).
Brian has experience at the trial and appellate court level in state and federal courts. At the trial court level, Brian regularly helps clients achieve quick dismissals in individual and class actions to avoid burdensome and expensive litigation. Brian has assisted in achieving complete defense verdicts at trial as second-chair in state and federal court. He also routinely drafts and argues discovery and dispositive motions and has considerable experience in electronic discovery.
In the appellate sphere, Brian has drafted briefs leading to victories in the Pennsylvania Superior Court, Pennsylvania Supreme Court and the U.S. Courts of Appeals for the Third and Fourth Circuits. Brian is also firmly committed to pro bono matters and has spent hundreds of hours counseling, litigating, and advising clients in disputes and transactional settings. He is also a regular contributor to the Technology Law Dispatch, and is frequently published on JD Supra, Lexology, and Law360 with respect to privilege issues, data privacy and data breaches, and rulings implicating the First, Fourth, and Fifth Amendments to the United States Constitution.
