He represents credit bureaus, background screening companies and other furnishers of sensitive consumer information, including credit data, criminal records and other public record information. He has also represented a wide array of other defendants subject to the FCRA, including retailers, a leading national airline and cellular phone companies.
Additionally, Albert’s practice includes routinely defending clients in lawsuits brought under the Telephone Consumer Protection Act (TCPA), and other privacy and consumer protection statutes and regulations on the federal, state and local levels. He provides compliance advice about the FCRA, the TCPA, and other statutory, regulatory, and legal requirements, including ongoing regulatory activities and rulemaking by the Consumer Financial Protection Bureau.
Handling all phases of complex commercial litigation, Albert appears frequently in both federal and state court and represents clients through different methods of alternative dispute resolution. He has represented clients in business and commercial disputes involving: land use and property issues, breach of contract, IP licensing agreements, outsourcing and manufacturing agreements, misappropriation of trade secrets, computer and software development agreements, and patent and trademark infringement.
He works with clients as well as internal and external IT professionals to ensure smooth and cost-effective electronic discovery, including developing preservation, collection, search, and review protocols. He routinely uses and coordinates information technology applications to support litigation efforts. Albert also routinely leverages his knowledge of technology and data when contesting class-certification motions.
