Nicole Soussan Caplan

In the energy industry, Nicole works closely with clients on a variety of legal disputes arising from oil and gas exploration and production and hydrocarbon transportation and storage. She also litigates breach of warranty claims, representing both plaintiffs and defendants in complex disputes governed by the UCC. Additionally, her experience includes handling claims involving personal injury and wrongful death, hydrocarbon trading, seismic data, theft, and environmental issues.

Nicole’s mass tort experience includes litigating against individual plaintiffs and state and county governments. She has successfully litigated these disputes in courts around the country, working to manage large defense groups, take extensive discovery against high-profile witnesses, argue high-stakes motions, and work up cases for trial, where she has served on the trial team.

As a commercial litigator, Nicole has experience developing cases from inception to appeal, but she also understands that a client’s business goal is often the most important consideration. Working with clients to develop a litigation strategy that best suits their business needs, Nicole has resolved cases prior to or in the early stages of litigation, and has obtained favorable rulings from appellate courts in cases where early resolution may have allowed for unfavorable precedent or inspired additional plaintiffs at significant cost to the client.  

Nicole is known for her strategic thinking, creativity, and client service – all of which inform her approach to effective problem-solving. Nicole embraces the use of technology and generative AI in her practice, working with clients to employ a variety of solutions to enhance work product, drive efficiencies, and accelerate case development and strategy.

Prior to law school, Nicole served as a Teach for America corps member and taught high school English. She remains active in pro bono and volunteer work involving civil rights, education, and the mentoring of young women. Nicole serves on the boards of the Anti-Defamation League, Girls, Inc. of Greater Houston, and Moonshots for Unicorns, and is active in both state and local bar associations, where she has served in numerous leadership roles. Nicole is also a fellow of the Texas Bar Foundation, Houston Bar Foundation, and Houston Young Lawyers Foundation.
