US trials often involve evidence from numerous countries that require navigating varied and sometimes conflicting laws on privacy and eDiscovery. These can pose sticky issues on admissibility of proof. This session will focus on challenges faced by in-house and outside counsel in collecting documents during discovery and preparing for trial in multi-jurisdictional or cross-border disputes. It will provide a global perspective on how new regulations and emerging privacy laws in foreign jurisdictions impact cross-border discovery and the ability to present documentary evidence and witness testimony at trial, as well as potential motions in limine and trial objections that parties need to anticipate in offering and using such data or testimony during trial. Through the session, attendees will become more prepared to handle concerns regarding accessing, maintaining, and using evidence, especially personal information, across borders during the discovery process and trials.
