Dubai Property Court’s interpretation of Law No. 13 of 2008
Dubai Law No. 13 of 2008 (“Law No. 13”) is one of a number of recent laws enacted by the Dubai Government to better regulate the real estate sector.
The effect of such regulation is now beginning to manifest itself, most recently through the published first instance decision of the Dubai Property Court in Real Estate Plenary Case 39/2009. Albeit still subject to possible appeal at this time, the Court has ruled on the effect of the failure of a developer to register a sale or disposition of units within its development on the new Interim Real Estate Register, pursuant to Article 3 of Law No. 13.
