Scope and Purpose

Insurance policies remain a critical source for recovery of environmental investigation, cleanup, and defense costs. The new environmental insurance also helps to protect against the broad-ranging liabilities imposed by federal, state, and local environmental laws and regulations.

On the retrospective side, sophisticated and innovative approaches are used to resolve complex and costly environmental insurance claims and lawsuits.

On the prospective side, an array of insurance mechanisms enables property owners, developers, Brownfields redevelopers, lenders, and others to gauge and limit their risks. These mechanisms constitute a key element in deals for acquisition, development, and redevelopment of commercial and industrial properties.

This annual advanced course of study examines these important areas of environmental insurance. The first day concentrates on resolution of insurance claims; the second focuses on the new environmental insurance coverage.

Offering both insurer and policyholder perspectives, the highly experienced faculty explores such current concerns and topical points as:

  • Categories of the new environmental insurance products;
  • Evaluating the usefulness of environmental insurance;
  • Negotiating the terms of environmental insurance policies;
  • Claims on the new insurance products;
  • Settlement strategies;
  • Negotiating insurance settlement agreements: essential points in drafting and consummating the deal; and
  • Key issues and latest developments on the insurance cost recovery scene, including bad faith claims, Natural Resource Damage (NRD) claims, and global warming/climate change claims.
