Global law firm Reed Smith represented national restoration contractor BluSky Restoration Contractors in a breach of restrictive covenants and trade secret misappropriation case against a former manager and a competitor where the manager was newly employed.

The case was handled in North Carolina Business Court, known for handling complex disputes. BluSky’s claims were supported by strong evidence and forensics experts.

The litigation team very capably prosecuted BluSky’s claims, and successfully fought off a strong attack on the trade secret claim at both the motion to dismiss phase and summary judgment. The former manager also brought counterclaims against BluSky, including alleged damages in the millions, which were all dismissed at summary judgment. Less than two weeks before trial, the opposing side agreed to an entry of stipulated judgments, recognizing the trade secrets and an obligation to return or destroy them. Additionally, as part of the resolution, the manager and the new employer agreed to a six-figure settlement payment in favor of BluSky.
