The California Office of Environmental Health Hazard Assessment (“OEHHA”) announced the approval of new amendments to regulations implementing the Safe Drinking Water and Toxic Enforcement Act of 1986, more commonly known as Proposition 65 (“Prop 65”). These amendments add clarification and guidance to Prop 65’s existing “clear and reasonable” warning regulations which were significantly updated in August 2016.

OEHHA’s amendments concern Prop 65 requirements for labeling, catalogs, the content of consumer product exposure warning, authorized agents, industry-specific warnings and other provisions. In this Client Alert, we explain the changes and cover the clarifications and guidance provided by OEHHA on certain key provisions.
