The new opinion holds that the Treasurer’s final audit decisions were within the statute of limitations if the court were to assume that an examination qualifies as an action or proceeding. The new opinion also makes it clear that jurisdiction is transferred back to the Michigan Supreme Court for further decision on whether an examination actually is an action or proceeding.
