For years, the mining sector in Africa has been one of the most important drivers of the continent’s growth, as well as a recurrent arena for international arbitration disputes. This is still the case.

In part one of our event, our distinguished speakers from Africa and beyond, who are representing the various stakeholders in mining arbitration in Africa (in-house lawyers, arbitration practitioners, governments, and arbitral institutions), will discuss the post-pandemic outlook for dispute resolution in Africa’s mining sector. This includes, notably, best practices to prevent mining disputes, governance issues from the perspective of the State and the investor, climate change and environmental protection, human rights, the roles of local communities, and more.

In part two of our event, our Oxford Union-style debate will address two motions:

  • Whether there should be no limit to a State’s right to enact tax and customs regulations in the mining sector
  • Whether an arbitral tribunal should be able to prevent parallel proceedings before national courts involving the investor

The event, to be held virtually, will be conducted in English and French.
