Introduction

More than thirty years after the enactment of the Foreign Trade Antitrust Improvements Act (FTAIA) in 1982, the extent to which United States antitrust laws apply to foreign or international transactions is now murkier than ever. It seems likely that courts will continue their struggle with defining the precise parameters of the FTAIA in 2013 and beyond.
