Mark counsels clients on privacy, data security, emerging technologies, and consumer protection issues faced by companies in today’s increasingly complex and interconnected world. He assists heavily regulated clients and clients with leanly staffed legal teams in anticipating risks associated with adopting emerging technologies (including AI and biometrics) and developing related products and services.
Mark also represents clients faced with internal investigations, cybersecurity incidents, government investigations, and related civil litigation, including consumer class action matters in state and federal courts nationwide. He was the lead brief writer at the trial and appellate stages in the recent successful defense of an e-commerce client facing multimillion-dollar class action wiretapping lawsuits in federal courts in Missouri, Pennsylvania, and Washington state. Mark frequently practices before the Federal Trade Commission (FTC) and other federal agencies. He is also experienced in legal and policy matters involving state attorneys general and works with clients to avoid state and multi-state investigations and related litigation.
Mark frequently counsels businesses and leads internal trainings and webinars on compliance with state and federal privacy, AI, and cybersecurity legislation and regulatory guidance. He also assists technology, media, banking, insurance, and health care clients with the development of internal policies and procedures, product review, privacy due diligence in the M&A context, and the review of related third-party agreements.
