Tom represents companies and individuals, particularly within the health care sector, involved in criminal and other government investigations and related civil litigation, including matters under the Foreign Corrupt Practices Act (FCPA), the False Claims Act (FCA), the Sherman Act, the federal Food Drug and Cosmetic Act, and the Anti-Kickback Statute.

Beyond the health care industry, he represents companies and individuals in domestic and international government investigations involving antitrust, securities fraud, political corruption, tax fraud, environmental violations, and economic espionage. He has extensive experience conducting international and domestic internal investigations and frequently counsels companies on compliance and voluntary disclosure issues related to the FCPA and health care compliance. He has handled FCPA and other internal investigations in numerous countries, including Russia, Poland, Turkey, Greece, Hungary, the Czech Republic, Mexico, and Colombia.

Obtained dismissal of RICO class action involving allegations of bribery and kickbacks through charitable co-pay contributions. MSP Recovery Claims, Series LLC v. Lundbeck LLC, No. 3:22-cv-422, 2023 U.S. Dist. LEXIS 50853 (E.D. Va. Mar. 24, 2023).

Obtained dismissal of FCA complaint on behalf of long term care provider. U.S. ex rel. Armes v. Garmon, No. 3:14-cv-00172 (June 24, 2016 E.D. Tenn.), aff’d, (No. 16-6212 6th Cir. Dec. 8, 2017).

Obtained dismissal of FCA complaint on behalf of orthopedic device manufacturer alleging off-label reimbursement. U.S. ex rel. Modglin v. DJO Global Inc., 114 F. Supp. 3d 993 (C.D. Cal. 2015)

Obtained verdict in favor of investment banker in SEC administrative trial involving alleged violations of Municipal Securities Rulemaking Board “pay to play” regulations. In the Matter of Anthony C. Snell, SEC Admin. Action No. 3-12359.

Obtained government declination and voluntary dismissal by relator of FCA complaint on behalf of medical device manufacturer involving alleged off-label promotion. U.S. ex rel. Paulos v. Stryker Corp., No. 4:11-cv-00041 (W.D. Mo.).

Represented senior executives of pharmaceutical company regarding alleged FCPA violations in Mexico.

Represented company in a criminal antitrust investigation involving alleged wage fixing of health care providers.
